Governing Legislation

The UGDSB must follow the rules set out in the Education Act and O. Reg. 374/23: ACQUISITION AND DISPOSITION OF REAL PROPERTY regarding dealings with property. The disposition process changed in December 2023.

The UGDSB may sell, lease or dispose of a school site, part of a school site or other property if it adopts a resolution that the property is not required for the purposes of the board, in accordance with Policy 311 Disposal of Board Properties.

The Minister of Education may also require a school board to sell, lease or dispose property if it is not needed to meet the board’s pupil accommodation needs for the next 10 years (mandatory disposition).

1) How is the property being sold?

The sale follows a structured legislative process required for public-sector assets. At this time, the property is being made available on the Open Market directly through the UGDSB. However, the UGDSB is in the process of obtaining the services of a commercial real estate firm to assist with the sale.

2) Why is the property offered for sale on Open Market?

The Ministry of Education completed a review of the property and, pursuant to subparagraph 2(ii) of subsection 5(1) of Ontario Regulation 374/23, formally notified the Board that it may proceed with offering the property for sale to any person or body at fair market value.

3) How is the "Fair Market Value" determined?

Under Ontario Regulation 374/23, the Board is required to sell surplus property at fair market value. This value is determined by an independent, third-party appraiser accredited by the Appraisal Institute of Canada. The appraisal considers the "Highest and Best Use" of the land, evaluating its potential for development rather than just its current state.

4) Do I need a Real Estate Agent?

5) Why are there no property tax amounts listed?

As a School Board is a tax-exempt entity under the Assessment Act, this property has not historically generated a tax bill. Upon transfer of title to a private owner, the tax-exempt status will be removed, and the property will be reassessed by the Municipal Property Assessment Corporation (MPAC).
